FBI, Boise police raid Boise Bench home, arrest man on felony drug, theft charges
David Allen Burke Officials with the Treasure Valley Gang Crime Task Force say more arrests are possible in connection with a raid on a Boise Bench home Monday morning where police were looking for guns and drugs. Federal gun charges are pending against David Allan Burke, 44, who was arrested during the raid at a home in the 4100 block of Lemhi Street and charged with felony drug possession and grand theft by the Boise Police. John Morton, an FBI agent based in Boise, said the raid was the culmination of six months of investigation, where task force members developed evidence that the resident of the home later identified as Burke was buying and selling guns and methamphetamine. Morton said the arrest warrants served at the home were to find guns, but investigators did not find any firearms inside. They did find a small amount of methamphetamine, which led to the drug possession charge being filed against Burke. There was one other person in the home during the raid but they were not charged While they didnt find any firearms in the home, task force officers acquired enough evidence during the investigation to file federal gun charges against Burke, Morton said. The investigation has also identified other suspects involved in the trafficking of guns and drugs and other arrests are possible, Morton said. Several armed officers surrounded the home around 10:30 a.m. Monday while a low-flying helicopter provided air support. Morton said that expanded police presence was necessary for public safety. Quite frankly, when you are talking about drugs like meth, and then you mix in firearms, well, that is a very dangerous combination, Morton said Tuesday. In that situation, we are going to do whatever we can to protect the public and our officers. The Treasure Valley Gang Crime Task Force includes officers from the Boise, Meridian, Nampa, Caldwell and Idaho State police agencies and Ada and Canyon county sheriffs offices along with federal agents with the FBI, DEA, and ICE (Immigration and Customs Enforcement). The task force is based in Canyon County and spends most of their time investigating gang crimes. Burke is being held in the Ada County Jail on the drug and grand theft charges. http://www.idahostatesman.com/newsup...ry/663276.html |

Re: But...but..but there were NO guns found...
The truth and facts are just a another tool used by criminals
to escape justise. No guns?...whats your point?...why should the facts matter? You will be charged with whatever the daily quota sheets say... |
Re: But...but..but there were NO guns found...
So a 6 month investigation that lead to them finding "a small amount of meth".
Trust me, when they say a "small" amount it's probably a residual trace left in a baggie. I wonder what the cost to the taxpayers was for a 6 month investigation? Federal Firearms charges, but no firearms... what did they find? Paperwork, Pictures??? Thanks for keeping us safe officers!!! |

I'm not gonna stick up for the guy one bit. He needs treatment for his drug addiction...who here has ever met a methhead they trusted? Just because they took his guns doesn't mean he's some "brother in arms" that deserves your pity or respect.
He's a drug addict, addicted to the worst drug, he'd steal your guns too if he needed a hit of that ice. |

Re: But...but..but there were NO guns found...
the ci the cops used may have been trying to eliminate the competetion. now the donut brigade will lean on the recent arrestee for more info. arrests will assure fed funding for the pd. all about the numbers and justifying the budget for next fiscal year. asset forfieture, good pr for the donut brigade, jow sixpack feels "safe" from the crim element. big circle jerk and poor use of tax[your] wealth.

Re: But...but..but there were NO guns found...
Prob'ly not a methhead, they can't think straight enough to fool the local PD. He's prob'ly b****ing out his old lady for not cleaning up after their party from th'other night.
Not sure about selling guns in ID but around here I believe you can't sell handguns without paperwork but longuns OK. |
Re: But...but..but there were NO guns found...
Private gun sales require no paperwork in Idaho. It's very easy to purchase a firearm in Idaho, both from an FFL and/or through private sale. Idaho's recent F+ rating says it all. (Way to go, Idaho).
The big push in Idaho is not anti-gun, but anti-meth. The state has had meth lab issues for years, especially in the Boise/Treasure Valley area, and my guess is that the police were willing to use any pretext to gain admission to this guy's house. |
Re: But...but..but there were NO guns found...
"Arrest Warrants" aren't served to find anything but the person named in the warrant.
If they went in looking for property (in this case "guns") it wouldn't be an arrest warrant. It would be a search warrant. I'm guessing the FBI (Famous But Incompetent) spokesman didn't know what he was talking about. |
Re: But...but..but there were NO guns found...
So this all goes back to that recent law that you:
NO LONGER NEED TO FIND WHAT THE WARRANT IS FOR IN ORDER FOR IT TO STICK You can get a warrant for anything, and no matter what you do or do not find, even if you aren't the right guy, those charges stick....because they still found "The evidence" |

I agree I might be reaching, but what's the more reasonable scenario? This guy is a meth-head that happened to be caught with only a small amount at the time of arrest OR he's an upstanding citizen who the FBI is trying to frame? He might not have had a large of Meth, but in my experience people are either 100% into Meth or 0% into it...it's all or nothing. Not, for example, like a person who can take a few hits of weed on the weekend without needing to smoke every day. I drink a shit-ton of beer, but if the Feds raided me after recycling day they might only find a few cans. |

A little more detail here ...
KIVI-TV 'Today's Channel 6 News' Feds Raid Boise Bench Home Posted: Feb 9, 2009 03:30 PM MST Updated: Feb 9, 2009 05:53 PM MST One man was arrested after a raid this morning on a Boise bench home. A six-month investigation by the Metro Violent Crimes Task Force resulted in the raid. FBI agents and Boise Police officers arrived at the home in the 4100 block of Lemhi Steet around 10:30 am Monday and arrested the owner for illegally trafficking guns. Public records from the Ada County Assessor's Office show the homeowner is David Allen Burke. FBI Senior Resident Agent-in-Charge John Morton says there is also a suspicion of meth being trafficked from the house and say this case is "gang-related." He declined to give details, citing an ongoing investigation. ‘This is connected to a larger organization and this case is still ongoing. We expect additional arrests," Morton says. The FBI says there was another individual inside the home at the time of the raid, but that person was eventually released. Officials would not immediately release the number of guns retrieved from the house. Neighbors who witnessed the raid said "it was like something out of a movie," with armed officers, tactical SWAT people and even a helicopter in the air above the neighborhood. |
